Terms of Service

These Terms of Service ("Terms") govern your access to and use of https://islandindex.mv (the "Service") operated by Island Index ("Island Index", "we", "us"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Agreement

These Terms apply to all users of the Service, including visitors and registered accounts. Additional policies, such as our Privacy Policy and Cookie Policy, form part of this agreement.

2. Eligibility

You must be at least 18 years old to create an account or post content. You confirm this by the date of birth you supply at sign-up, which we verify on the server. You must not create or use an account for anyone under this age. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

3. Your account

• You are responsible for your login credentials and for anything done under your account.
• You must keep your two-factor authentication and recovery details secure.
• You may not share your account or transfer it to someone else without our written permission.
• You must notify us immediately if you suspect unauthorised access.
• We may suspend or terminate accounts that violate these Terms.

4. Your content

• You own the content you post (text, images, reviews, etc.), or you have the rights to post it.
• By posting content, you grant us a non-exclusive, royalty-free, worldwide, sublicensable licence to use, copy, display, modify (only to the extent necessary to operate the Service, e.g., resizing images), and distribute it to operate and promote the Service. This licence ends when your content is permanently deleted from our systems.
• You are responsible for the accuracy of information you publish, including prices, availability, contact details, and location data.
• You must not post content that is illegal, defamatory, harassing, hateful, sexually explicit in violation of our rules, or that infringes someone else's rights.
• Post text and images you submit are automatically checked for content policy compliance before and after publication, as described in section 5 of our Privacy Policy.
• We may cache, back up or retain deleted content for a short period as described in our Privacy Policy, for safety, abuse prevention or legal compliance.

5. Acceptable use

You agree not to:

• Use the Service in a way that violates any law of Republic of the Maldives, or any other applicable law.
• Impersonate anyone, or misrepresent your affiliation with a business or person.
• Scrape, harvest, or bulk-download content or user data by automated means, except where a documented API or permitted export exists.
• Attempt to bypass security controls, rate limits, or access non-public areas.
• Upload malware, spam, or engage in deceptive practices.
• Misuse the booking, messaging or advertising features.

6. Business pages and verification

Business pages are for legitimate businesses operating in the Maldives. If you apply for a verified badge, you must submit accurate supporting documents. Verification is granted at our discretion and may be suspended or revoked if the information changes, is false, or the page breaches these Terms. We do not guarantee that verification will be approved, and we do not promise a review turnaround time.

7. Advertising

Advertising campaigns run according to the rules described in our Help Center. Campaign start and end dates are as recorded at the time of approval and are not automatically changed after booking. Every campaign is reviewed by a person before it goes live. Text coverage in ad creatives is a guideline of up to 20% of the image area, applied by a reviewer rather than by an automated measurement, so exceeding it is not automatically rejected — but a reviewer may ask you to change it. Review timing varies with queue volume and is not promised within a fixed number of hours. Audience targeting is not currently available: a campaign is shown to the general audience in the placement you select. Within each placement, live campaigns rotate equally: price and duration do not buy a larger rotation share, and more live campaigns reduce each campaign's share equally. Estimated daily impressions shown in the ad builder are planning figures based on recent traffic and live inventory, not promised volumes. We do not guarantee impressions, clicks, results, sales, conversions, or return on investment.

If payment details have not been published by us, the platform will not display bank transfer details. In that case, contact support to arrange payment. We never ask you to transfer funds to an account communicated in any other way, including by message from another user.

8. Bookings and travel

Island Index connects you to hotels, resorts, stays and service providers. We do not own, manage or operate those properties. A booking request submitted through the Service is passed to the property to confirm availability and terms. Prices, availability and policies (cancellation, refund, check-in) are set by the property. We do not guarantee that any booking will be accepted or honoured, or that information shown is error-free. Any dispute about a stay or payment is between you and the property.

9. Moderation and enforcement

We may review content, reports and accounts to enforce these Terms and applicable law. Actions we may take include removing content, limiting visibility, issuing warnings, disabling features, suspending or terminating accounts, or restricting access. Content may be screened automatically to prioritise review, but final decisions that affect an account are made with human oversight. We do not guarantee a response time for reports. We are not liable for any loss resulting from enforcement action taken in good faith.

10. Intellectual property

The Service, including its design, code, logo, trademarks and other original elements, is owned by Island Index and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service unless expressly permitted in writing. You retain copyright in your content; the licence granted in section 4 is limited to operating the Service. If you believe your copyright has been infringed, contact us with details and we will investigate promptly.

11. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, availability, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. Content is provided by users and third parties; we do not verify every statement and are not responsible for its accuracy.

12. Limitation of liability

To the maximum extent permitted by law, Island Index, its directors, officers and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the Service. Our total liability to you for any claim arising under these Terms is limited to the amount you paid us in the 12 months before the claim arose, or MVR 500, whichever is greater. These limitations apply even if we have been advised of the possibility of damages. Nothing in these Terms excludes liability that cannot lawfully be excluded.

13. Indemnification

You agree to indemnify and hold Island Index and its affiliates harmless from and against any claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising out of your content, your use of the Service, your breach of these Terms, or your violation of any rights of another person or law.

14. Termination

You may close your account at any time. We may suspend or terminate your access without notice if you breach these Terms, if we must do so to comply with law, or to protect the safety or security of the Service or others. Sections 4 (licence granted), 10 to 14, and any payment obligations survive termination.

15. Governing law

These Terms are governed by and construed in accordance with the laws of Republic of the Maldives. Any dispute arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Republic of the Maldives.

16. Changes to these terms

We may update these Terms from time to time. The date at the top indicates the current version. Material changes will be announced on the Service before they take effect. Your continued use of the Service after the effective date means you accept the updated Terms.
